By accessing or using the website at concretewhiteplains.com (the "Site"), requesting a quote, or entering into a service agreement with White Plains Concrete Company, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use the Site or engage our services.
These Terms and Conditions apply to all visitors of the Site and to all customers who engage White Plains Concrete Company for concrete contractor services. Use of this Site constitutes acceptance of these terms as of the date of first use.
White Plains Concrete Company provides residential and commercial concrete contractor services in White Plains, NY and surrounding areas. Services include but are not limited to: concrete driveway installation, patio construction, stamped concrete, sidewalk installation, garage floor concrete, decorative concrete, retaining walls, floor installation, pool decks, steps construction, slab foundation work, foundation installation and raising, parking lot construction, concrete footings, and concrete cutting.
The scope of work for any individual project is defined by a written estimate or contract issued by White Plains Concrete Company. Work not listed in that written estimate is not included and will be subject to a separate quote if requested.
All estimates provided by White Plains Concrete Company are free of charge and carry no obligation. Written estimates are based on the information available at the time of the site visit and are valid for 30 days from the date of issue unless otherwise stated in writing.
Estimates may be subject to revision if site conditions differ materially from what was observed during the initial visit - for example, if underground obstructions, drainage complications, or permit requirements are discovered after work has begun. Any change to the original estimate will be communicated to the customer in writing before additional work proceeds.
Prices on the Site, if any, are provided for general informational purposes only and do not constitute a binding quote for any specific project. Final pricing is determined by the written estimate.
Project start dates are scheduled at the time of contract execution and are subject to availability, permitting timelines, and weather conditions. Concrete work cannot be performed when temperatures are expected to fall below 40 degrees Fahrenheit during the curing window, or during heavy rain or other unsafe site conditions. White Plains Concrete Company will notify customers of schedule changes as early as possible.
Customers who wish to cancel a project after signing a contract must notify White Plains Concrete Company in writing. Cancellations made before material has been ordered or permits have been filed will incur no cancellation fee. Cancellations made after materials have been ordered or permits filed may be subject to a fee equal to the actual costs incurred, including permit fees, materials restocking charges, and any mobilization costs already expended.
Payment terms are outlined in the written estimate or contract for each project. Unless otherwise agreed in writing, a deposit may be required before work begins and the remaining balance is due upon project completion. Final payment is due at the time of completion unless a different schedule is specified in the contract.
Payments not received by the due date may be subject to a late fee. If a balance remains unpaid for more than 30 days after the due date, White Plains Concrete Company reserves the right to pursue collection through appropriate legal channels. The customer agrees to pay any reasonable collection costs or attorneys fees incurred as a result of non-payment, to the extent permitted by applicable law.
Many concrete projects in White Plains and Westchester County require permits issued by the local building department. Where a permit is required, White Plains Concrete Company will obtain it on behalf of the customer unless otherwise agreed in writing. Permit fees are the responsibility of the customer and will be included in the written estimate.
The customer is responsible for disclosing the location of any underground utilities, irrigation lines, or other buried infrastructure on their property prior to work beginning. White Plains Concrete Company is not liable for damage to undisclosed or unmarked underground utilities.
White Plains Concrete Company warrants that all work will be performed in a professional manner consistent with industry standards for concrete contractor work in New York State. Specific warranty terms, if any, will be stated in the written contract for each project.
The warranty does not cover damage caused by: customer misuse or neglect; failure to follow post-installation care instructions (such as sealing schedules and curing timelines); acts of nature including but not limited to freeze-thaw damage resulting from failure to seal; damage caused by tree roots or underground movement not disclosed prior to work; or modifications made to the work by parties other than White Plains Concrete Company after completion.
Except as stated in the written contract, all materials and workmanship are provided "as is" without additional express or implied warranties. The implied warranties of merchantability and fitness for a particular purpose are disclaimed to the fullest extent permitted by New York law.
To the fullest extent permitted by applicable law, White Plains Concrete Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the use of the Site, the services provided, or any failure to perform services. This includes but is not limited to lost profits, loss of use, or damage to property not directly caused by our work.
In all cases, White Plains Concrete Company's total liability for any claim related to a specific project shall not exceed the total amount paid by the customer for that project. Some jurisdictions do not allow the limitation of liability for certain types of damages, so the above limitation may not apply to you in full.

These Terms and Conditions and any disputes arising from them are governed by the laws of the State of New York, without regard to its conflict of law provisions. The New York Home Improvement Contractor laws and the rules of the New York State Department of State apply to all residential service work performed under these terms.
White Plains Concrete Company reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or engagement of our services after any changes means you accept the revised terms. We encourage you to review this page periodically.
